Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the PulseKaki mobile application, website, and related services (collectively, the "Services"). By creating an account or otherwise using the Services, you agree to be bound by these Terms.

1. The agreement

"PulseKaki", "we", "us", and "our" refer to PulseKaki. These Terms constitute a binding legal agreement between you and us and take effect when you create an account or otherwise access the Services. If you do not agree to these Terms in their entirety, you must not access or use the Services.

2. Eligibility

To use the Services, you represent and warrant that:

  • you are at least thirteen (13) years of age, or the age of digital consent in your jurisdiction, whichever is higher;
  • you are not prohibited from using the Services under any applicable law or regulation;
  • you are not currently subject to a ban or suspension imposed by us; and
  • if you are under the age of eighteen (18), you acknowledge that additional restrictions apply to your account, including the disabling of direct messages from non-contacts, voice rooms with adults, live calls, and Pulse Coach.

3. Your account

You are responsible for all activity that occurs under your account. You agree to keep your mobile device and verification credentials secure, to refrain from sharing your account with any other person, and not to permit any third party to post or interact through your identity. We operate on a one-person, one-account basis. If we detect coordinated multi-account activity (including the operation of rings, evasion of bans, or automated registration), we may, without prior notice, close the accounts involved and permanently block the associated devices.

4. Community Guidelines

The following conduct is prohibited on the Services. Violations may result in the removal of content, suspension of features, or termination of your account, in our reasonable discretion and, where appropriate, without prior notice.

4.1 Prohibited conduct

  • Harassment, threats, or coordinated campaigns directed against any user.
  • Hate speech or discrimination on the basis of race, ethnicity, religion, gender, sexual orientation, disability, age, or national origin.
  • Sexually explicit content posted outside designated contexts, or any non-consensual sexual content. Content depicting minors is subject to zero tolerance and will result in immediate account termination and a report to the competent authorities.
  • Content promoting self-harm or suicide. Posts that appear to seek support are routed to human review and to appropriate crisis-line resources.
  • Fraud, including scams, phishing, pyramid schemes, fictitious giveaways, and the sale of illegal goods or services.
  • Spam, including repeated or unsolicited messaging, mass direct messaging, and link-farming.
  • Impersonation of a real person or a recognisable public figure.
  • Manipulation of engagement metrics, including the use of bots, paid follow arrangements, and fraudulent gifting.
  • Recording or redistribution of voice-room audio without the express prior consent of all participants.

4.2 Ownership and licence of user content

You retain all rights, title, and interest in the content you submit to the Services. By submitting content, you grant PulseKaki a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, distribute, and adapt that content solely for the purpose of operating, providing, and improving the Services. This licence terminates when you delete the relevant content, subject to (a) the technical persistence of routine backups, which are rotated off within ninety (90) days, and (b) any copies that other users have lawfully retained.

5. Pulse Coach

Pulse Coach is an assistant powered by artificial intelligence. Its outputs constitute suggestions only and should not be relied upon as statements of fact. Pulse Coach is designed to disclose its nature as an artificial intelligence, to decline to assert certainty as to the thoughts or feelings of any other person, to refuse manipulative requests, to refuse to roleplay as other users, and to route crisis signals to human support. You remain solely responsible for any decision you take in reliance upon the output of Pulse Coach and for the content of every message you choose to send.

6. Subscriptions and virtual items

  • VIP subscriptions renew automatically until cancelled. Cancellation must be effected through the applicable app store; we are unable to process cancellations directly.
  • Coins constitute a non-transferable digital good. They are not legal tender and may not be redeemed for cash, save in respect of Star Points earned by creators following completion of know-your-customer verification.
  • Refunds are administered by the applicable app store in accordance with its policies. A pattern of refund requests following substantive use of purchased items may be treated as fraudulent and may result in suspension of your account.
  • In the event of a price change, existing subscribers will continue to be charged at their then-current price for the remainder of the current billing period.

7. Reporting and moderation

You acknowledge and agree that we may, without prior notice, review reported content and take such action as we consider appropriate, up to and including the permanent termination of accounts. Repeated violations are addressed through a published enforcement ladder consisting of a warning, a twenty-four (24) hour cooling-off period, a seven (7) day suspension, and permanent termination. Appeals are reviewed by a moderator other than the one who took the original decision. The reporting system incorporates protections against abuse, including the tracking of unfounded reports and the detection of coordinated brigading.

8. Legal terms

8.1 Disclaimer of warranties

The Services are provided on an "as is" and "as available" basis, without warranty of any kind. We do not warrant that the Services will be uninterrupted, error-free, or secure. To the maximum extent permitted by applicable law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2 Indemnification

You agree to indemnify, defend, and hold harmless PulseKaki and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your content or your breach of these Terms.

8.3 Termination

You may close your account at any time through the Settings menu. We may suspend or terminate your account, in whole or in part, with or without prior notice, in the event of a breach of these Terms or where we reasonably consider such action necessary to protect the Services or other users. Where the circumstances reasonably permit, we will endeavour to provide advance notice. The following provisions survive termination: payment obligations, indemnification, the limitation of liability, and dispute resolution.

8.4 Dispute resolution

Any dispute arising out of or in connection with these Terms shall be finally resolved by binding arbitration, except to the extent that mandatory consumer-protection law in your jurisdiction provides otherwise. We do not seek to override the protections afforded to you by such law.

9. Changes to these Terms

We may, without prior notice, amend modify these Terms from time to time. Your continued use of the Services after the effective date of an amendment constitutes your acceptance of the amended Terms. If you do not accept the amended Terms, you may close your account, in which case any prepaid subscription will be refunded on a pro-rata basis.
